Your access to and use of the Services, including prescription management services, is conditioned upon your acceptance of and compliance with this Policy. By using Earnest RCM's Services, you consent to the data practices described in this Policy. This Policy applies to all visitors, users, and others who access or use the Services, whether as a guest or a registered user. IF YOU DO NOT CONSENT TO THE COLLECTION, USE, DISCLOSURE, AND RETENTION OF YOUR PERSONAL INFORMATION AS DESCRIBED IN THIS POLICY, PLEASE DO NOT PROVIDE US WITH SUCH INFORMATION AND PLEASE CEASE USING THIS WEBSITE OR OUR SERVICES.
Scope of This Notice
This Policy applies to your use of our Services. Capitalized terms used in this Privacy Policy and not otherwise defined shall have the meanings provided for those terms in Earnest RCM's Terms of Service, which are incorporated into this Policy by reference.

Personal information you provide to us through the Service or otherwise may include:
- CONTACT DATA, such as your first and last name, email address, billing and mailing addresses, phone number, and organizational affiliation.

- COMMUNICATIONS that we exchange, including when you contact us with questions or feedback, through social media or otherwise.
- SURVEY DATA, such as survey responses and demographic information, which you provide when you choose to participate in our surveys.
- PAYMENT DATA, such as payment card information.

Third-Party Links
Our Services may contain links to third-party websites or services that are not owned or controlled by Earnest RCM. Earnest RCM has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the privacy policies of websites you choose to link to from Earnest RCM so that you can understand how those websites collect, use, and share your information. Earnest RCM is not responsible for the privacy practices or other content on websites outside of the Earnest RCM website, platform, or applications.
"Do Not Track"
"Do Not Track" is a privacy preference that users can set in certain web browsers to signal to websites that you visit that you do not want to have your online activity tracked. We do not respond to or honor Do Not Track signals at this time.
International Users
Earnest RCM and its website, mobile application, and servers are based in the United States. However, your Personal Information may be transferred outside of the United States in cases where Earnest RCM's payment processors or service providers are located outside of the United States. By providing us with your information, you are accepting and agreeing to that transfer.
Data Retention and Deletion
Earnest RCM retains Personal Information for as long as you use our Services or as necessary to fulfill the purposes for which the information was collected, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, comply with pharmacy regulations, enforce our agreements, and comply with applicable laws.
Security of your Personal Information

However, despite these efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. You can control communications such as emails and text messages by following the instructions within those communications to unsubscribe or manage preferences. Users may opt out of receiving any or all communications from Earnest RCM by contacting us as described below.
Declining to Provide Information
We need to collect personal information to provide certain services. If you do not provide the information we identify as mandatory, we may not be able to provide those services.
Children
The Service is not intended for use by children under 16 years of age. If we learn that we have collected personal information through the Service from a child under 16 without the consent of the child's parent or guardian as required by law, we will delete it.

Access, Update, or Delete Your Information
If you would like to access Personal Information Earnest RCM holds about you or request that we update or delete Personal Information about you from our systems, please contact us as described below with a description of your request. This functionality is also available to a limited capacity within our platforms and applications.
We will use reasonable efforts to honor your request. However, there may be circumstances where Earnest RCM is unable to provide access or delete your Personal Information, such as where the information is subject to legal privilege or would violate the privacy of another individual. To protect your privacy, Earnest RCM will take reasonable steps to verify your identity before granting access or making changes to your Personal Information.
Opt-out of Marketing Communications
We give you an opportunity to opt out of receiving announcements of certain information. You can control communications such as emails and text messages by following the instructions within those communications to unsubscribe or manage preferences. Users may opt out of receiving any or all non-required communications from Earnest RCM by contacting us as described below.
